Are Court Records Public in Le Sueur County?
Under the Minnesota Government Data Practices Act (MGDPA), codified at Minnesota Statutes Chapter 13, all government data is presumed to be public unless a specific statute classifies it as private, confidential, or protected nonpublic. This presumption of public access applies broadly to court records maintained by the Le Sueur County District Court.
That said, several categories of records are restricted from general public disclosure:
- Juvenile records: Cases involving minors are confidential and not accessible to the general public.
- Domestic abuse records: Certain records from domestic abuse proceedings carry specific access restrictions under Minnesota law.
- Attorney-client privileged communications: These materials are protected from disclosure regardless of their location in the court file.
- Records sealed by court order: A judge may seal specific case files, limiting access to parties and authorized personnel only.
- Records exempt by state or federal statute: Any record specifically classified as private or confidential by applicable law is withheld from public inspection.
Restricted records are not permanently inaccessible in all situations. A person seeking access to otherwise confidential records may petition the court for an order permitting disclosure. The MCRO online portal automatically filters out confidential and sealed cases, so records not visible there may still exist but be restricted by law or court order.
